Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: At this worksite, employees engaged in tree trimming operations were exposed to serious fall hazards in that: a.Employees were not instructed in the proper use, inspection, and maintenance of tools and equipment. b.Employees did not have available at least two means of fall protection while working aloft. One means of correction is, but not limited to, for the employer to comply with paragraph 4.1.2 and paragraph 9.1.3 of ANSI 133.1-2000 Pruning, Repairing, Maintaining, and Removing Trees, and Cutting Brush-Safety Requirements.
