Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being caught in or crushed by a fork lift or the fork lift load: a)Pipe Plant: Fork lift operators, not wearing seat belts, were exposed to being thrown from the seat, being caught in or crushed by the fork lift or load while operating a Komat-su fork lift, model FG25T-14, serial number 592859A when moving materials. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: 1)Conform to the requirements of the Komat-su, FG25T-14 Operators manual, page 2-5 that states, "Always fit your seat belt correctly when operating. . . there is a danger of serious personal injury if the lift truck should tip over." 2)Conform to the requirements of ASME/ANSI B56. la-1989 Addenda to ASME B56.1-1993 Safety Standard that requires the use of seat belts and for manufacturers to develop a program to retrofit older models. 3)Conform to the requirements of the Non Metallic Resources, Inc. employee handbook, page 3 forklift safety section reads, "If the forklift has a seat belt, wear it! This is an important feature that may protect you in case of an accident. A seatbelt will help to hold you in the frame of the safety cage." ABATEMENT CERTIFICATION REQUIRED.TION
