Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees operating industrial fork lift trucks were exposed to tipping and crushing injuries from not wearing seat belts: (a)On or about June 10, 2008, on the dock, for employees moving freight using Hyster 40 industrial fork lift trucks equipped with operator restraint systems with no cinch seat belts that were not required to be worn while operating the truck. Feasible and acceptable means to correct this hazard include enforcing the wearing of seat belts while operating the fork lift trucks. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
