Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to a crushing or other hazards associated with employees not being restrained in the forklift in case of tipping or a rollover. A feasible and acceptable method to correct this hazard would be to Install a seatbelt on this unit and enforce its use according to the requirements in ASME/ANSI B56.1-2000 "Safety Standard for Low Lift and High Lift Trucks". Or in the alternative: CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a)On or about June 26,2007; Toyota industrial lift truck #9, located at the block manufacturing plant, was not equipped with a seatbelt exposing operators to a potential crushing hazard in the event of a tipover or rollover. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
