Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees engaged in the collection of residential refuse were exposed to the hazard of falling from and/or being struck by the mobile refuse collection truck being used: a)On or about 04/03/08 two Labor Ready employees rode on the riding steps of a compacting truck while traveling in excess of 10 mph. b)On or about 04/03/08 two Labor Ready employees rode on the riding steps of a compacting truck while traveling in reverse. c)On or about 04/03/08 two Labor Ready employees rode on the riding steps of a compacting truck while traveling uninterrupted distances in excess of 0.2 miles. d)Two Labor Ready employees working under the direction of BBI Waste Industries from March 31st through April 4th were not trained in the hazards and safe practices associated with standing on the riding step of compacting trucks; such as but not limited to traveling in reverse, maximum travel speeds, and maximum travel distances between trash pickups. e)Warning signs were not affixed to the sides of compact truck #24 above the riding steps and at the driver's station with wording such as: "Warning-Do not use riding steps when the vehicle is exceeding 10 mph, operating in reverse, or when distance traveled exceeds 0.2 miles. Do not mount or dismount step when vehicle is in motion. Ride facing the side of the vehicle with both hands on hand holds." One feasible and acceptable abatement methods, among others, to correct these hazards are to comply with BBI Waste Industries Employee Safety Book Sections 16.6 and 16.8, as well as comply with the safety standards in the Environmental Industry Association's ANSI Z245.1 - 1999: for Equipment Technology and Operations for Wastes and Recyclable Materials - Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment Safety Requirements, including, but not limited to paragraph 6.2.5.4, 7.2.11.6, and 9.3.
