Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)On or about May 14, 2008 - Chick-Fil-A, 9345 Parkway East, Birmingham, AL, an employee was using an aerial lift to carry and lift a light pole. Among other methods, one feasible and acceptable method to correct this hazard would be to prohibit the use of an aerial lift as a crane or lifting device. For further assistance, refer to the JLG Operation and Safety Manual and ANSI/SIA A92.5-2006, Boom-Supported Elevating Work Platforms.
