Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when being raised on a wooden pallet by a material lift to access the openings of a grain bin. a/Workers were driving lulls, high clearance material handling equipment, to move tubs of concrete and stacks of brick from one construction area out onto two public streets and back into the parking lot and to another construction area. The machinery was not marked to warn public traffic of the slow speed they were traveling at, and no warning signs had been posted to alert traffic of machinery entering or leaving the construction site, even though the machinery was regularly driving in traffic at speeds less than 25 mph. While ultimate responsibility for correcting the hazard rests with the employer, given his/her superior knowledge of the work place, feasible and acceptable methods of abatement to correct this hazard, among others, are: 1. Follow American Society of Automotive Engineers Standard R276, 1967 or S276.2 1971, or the American National Standards Institute ANSI B114.1 SLOW-MOVING VEHICLE IDENTIFICATION EMBLEM and place a slow-moving identification emblem on each of the material handling lifts on the rear of the vehicles in a manner meeting the guidelines of the safety standard. ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS VIOLATION. The documentation should include written verification of abatement, or monitoring results, and photographs or videos which you believe will be helpful. The certification sheet is enclosed with the citation(s).n
