Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing and struck by hazards associated with moving a
skid steer loader while
sitting on the battery compartment with the cab and bucket in raised
positions:
7 Industrial Way, Whitman, Ma.:
On or about 10-27-08 a mechanic was attempting to move Mustang Skid Steer
Loader  Serial
Number 801126, Model # 2105 while sitting on the battery compartment with
the bucket raised
and the cab partially raised. A safety stop for the piston of the bucket
arms was not in place.
The safety wires for the cab restraint bar were disconnected. The employee
suffered internal
injuries and back injuries when the cab struck and crushed him.
Methods of abatement include:
1) Retrain the repair mechanics on the proper safety procedures for
moving, for troubleshooting,
and for repairing the skid steer loader per manufacturers manual.
2) Retrain the repair mechanics to use the manual lifting arm piston stop
when the bucket is
raised.
3) Retrain the repair mechanics to lift the cab high enough for the cab
safety stop to fall into
place
4) Reconnect the safety wire for the cab restraint
5) Conduct safety inspections of the skid steer loader to ensure that all
safety mechanisms are
in place.
6) Hold management and employees accountable to ensure that all safety
mechanisms are in
place and to ensure that the manufacturer maintenance and operating
procedures
are followed;
7) Develop written procedures in accordance with the manufacturers manual
on how to control
hazardous energy during the repair process (lockout tagout). Ensure that
all repair mechanics
are trained in these procedures.rs
