Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of being struck by falling loads being hoisted using equipment that was not designed to hoist loads. Location: Barge at Chelsea Street Bridge On or about 12/01/08, employees were exposed to struck by hazards when 12"X12"X24'3" timbers were being hoisted by a Genie S-60, serial number 1954, aerial lift that was prohibited from this operation by the manufacturer.
