Section 5(a)(1) of the Occupational Safety and health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to dust explosion, deflagration or other fire hazards:
(a) Cocoa powder line, dump station:  Employees working in the cocoa
powder line were
exposed to fire and/or explosion hazards in that the method used to dump
1600 pound supersacks
of cocoa powder into the hopper did not prevent combustible cocoa powder
from escaping into
the surrounding environment.
Among other methods, one feasible and acceptable abatement method to
correct these
hazards is to use methods to prevent the escape of cocoa powder from
process equipment
into the surrounding environment, as set forth in Chapter 10.3.1 of the
National Fire
Protection Association (NFPA) 61, Standard for the Prevention of Fires and
Dust
Explosions in Agricultural and Food Processing Facilities.
(b) Cocoa powder line, Craftsman portable vacuum:  Employees working in
the cocoa powder
line were exposed to fire and/or explosion hazards due to the use of a
Craftsman portable
vacuum, which is equipped with a standard i.e. spark-producing motor to
clean easily ignitable
combustible cocoa powder.
Among other methods, one feasible and acceptable abatement method to
correct these
hazards is to use a portable electric vacuum cleaner that is listed for
use in Class II
Group G, Division 1 atmospheres as defined in the National Electrical
Code, as set forth
in Chapter 10.2.3 of the National Fire Protection Association (NFPA) 61,
Standard for
the Prevention of Fires and Dust Explosions in Agricultural and Food
Processing
Facilities.
(c)  Cocoa powder line, dust collectors: Employees working in the cocoa
powder line were
exposed to fire and/or explosion hazards because dust collectors for
combustible cocoa powder
were located inside the building and were not equipped with fire/explosion
prevention,
suppression, venting, and/or containment systems.
Among other methods, one feasible and acceptable abatement method to
correct these
hazards is to locate the dust collectors outside the building and provide
fire/explosion
prevention, suppression, venting, and/or containment systems, as set forth
in in Chapter
10.4.3 and Chapter 6.3 of the National Fire Protection Association (NFPA)
61, Standard
for the Prevention of Fires and Dust Explosions in Agricultural and Food
Processing
Facilities.l
