Section 5(a)(1) of the Occupational Safety and Health Act of1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
likely to cause death or serious physical harm to employees in that the
employees were exposed
to the hazards associated with standing, walking, or working within close
proximity to a stack-
loaded powered industrial truck.
Jobsite: Facility.
On June 3, 2009, a worker was crushed and killed while he was working in
close
proximity to a fork truck that was carrying two (2) stacked insulated
boxes ("totes")
when the stack became unstable and tipped over onto him.
One feasible means of abatement, among others, would be to prohibit
employees from
being in close proximity to working fork trucks and to include in the
company training
program an element to be constantly aware of load heights in order to be
out
of radius
in the event of a load tipping off of the forks.g
