Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls, caught between and/or struck by hazards while operating a scissors lift at the edge of the loading dock. At the site: An employee who was operating a scissors lift was injured when the scissors lift that he was operating fell from an unguarded loading dock. Among other methods, one feasible and acceptable means of abatement would be to operate the scissors lift in accordance with the instructions given in the Operators and Safety Manual to keep the scissors lift chassis a minimum of 2 feet from dropoffs.
