North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees:
a)Site:  Employer did not develop, implement, and maintain a process of
frequent and periodic
inspections of the three hoist systems operated in the facility.

Chapter 11-2 - Inspection, Testing, and Maintenance
Section 11-2.1.2 - Frequent Inspections:
a)Frequent inspections shall be performed at intervals defined in
paragraph 11-2.1.1(b)(1) [normal service - monthly] and shall include
observations during operation.
Section 11-2.1.3 - Periodic Inspections:
a)Periodic inspections shall be performed at intervals defined in paragraph
11-2.1.1(b)(2) [normal service, equipment in place, annually.
NOTE:Among other methods, one feasible and acceptable method to correct
this hazard is to
implement a process of inspections by competent individuals of the three
hoist systems
following the schedule and inspection criteria outlined in ANSI/ASME
B30-11, Chapter
