Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from not being restrained in a forklift in case of tipping and/or rollover: a)Onboard barge HALEIWA: A longshoreman was operating a Hyster 19,150 pound forklift while discharging lumber from the barge and was not wearing the seatbelt installed on the equipment. b)Onboard barge HALEIWA: A longshoreman was operating a Hyster 19,159 pound forklift while discharging lumber from the barge and was not wearing the seatbelt installed on the equipment. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO EFFECTIVELY ENFORCE THE USE OF SEATBELTS WHILE EMPLOYEES ARE OPERATING FORKLIFT TRUCKS AS REFERENCED IN ASME B56.1-2000 "SAFETY STANDARDS FOR LOW AND HIGH LIFT TRUCKS".S
