Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or crushed by hazards: a)Wastewater Treatment Plant- John Deere 310 SG Backhoe, Outrigger was modified with bolt & nut instead of the original cutter pin. AMOUNT OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD: 1.To FOLLOW the American Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts are replaced and, 2.To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and 3.To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in service.
