Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on or about June 11, 2008, and at times prior thereto, at a workplace located at 2919 Maple Street, Dallas, Texas; employees on the job site were exposed to a struck-by hazard from the falling load block and hook when the lower load block and jib trolley two-blocked. Feasible and acceptable means of abatement includes but are not limited to: (1) Ensuring that all operator aids regarding travel limits of the hoisting mechanisms to stop the upward motion of the load block are not overridden and are checked and inspected to ensure they are working in accordance with the manufacturers requirements and ASME B30.3. (2) Ensure that the operator can observe the lower load block and trolley through all areas of travel while in operation. (3) Ensure that the establishment of the upper travel limit is not relied upon as the only prevention measure of a two-blocking situation. (4) Conduct operational tests of actuating devices or settings so that it will trip the device under all conditions in sufficient time to prevent contact of the lower load block with the upper load block or boom point sheaves in accordance with ASME B30.3. (5) Check all indicating devices daily before the crane is put into operation.
