Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) On or about September 12, 2008, and at times prior thereto, employees were exposed to a crushing/struck by hazard while operating forklift trucks without wearing seat belts. Among other means, one feasible and acceptable method of abatement is to instruct employees and enforce the use of wearing seat belts while operating the forklifts.
