Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on or about November 04, 2008, and at times prior thereto at a workplace located at South Central Expressway & US Highway 175, Dallas, Texas: at least four employees were exposed to a tip over and struck-by hazard by exceeding the maximum platform capacity of a Genie S-40 Stick Boom Personnel lift. Among other feasible methods, one feasible and acceptable means of abatement includes but is not limited to following the manufacturers requirement that occupants, equipment and materials do not exceed the maximum capacity of the platform of not more than 2 occupants and a maximum capacity of 500 pounds.y
