Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees:
On or about Dec 31, 2008 and times prior to, at the automotive vehicle
recycling yard,
employees were allowed to operate forklifts and/or loaders that were not
equipped with
seatbelts. Among other abatement methods, feasible and acceptable
abatement methods to
correct this hazard is to re-install appropriate seatbelts as designed by
the manufacturers, and
provide safety training to operators to ensure they use seatbelts and not
remove seatbelts
from the equipment.
