General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from an elevated platform which was not attached to the forks of the forklift and was being moved horizontally. On or about April 13, 2009, and times prior thereto, the basket being used to move and position personnel was not attached to the forklift to prevent displacement. Among other methods, at least one feasible and acceptable method to correct the hazard is to utilize the Toyota forklift truck in accordance with the purposes for which it was designed. Or in the Alternative: 29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: On or about April 13, 2009, and times prior thereto, the basket being used to move and position personnel was not attached to the forklift to prevent displacement.
