Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls: On or about July 24, 2009, at a job site located at 102 Jim Miller Road in Dallas, Texas 75228, an employee, who was ascending to and descending from the roof of the Beauty Supply and Super Wash & Dry to change HVAC filters, was exposed to fall hazards while climbing a 12 foot fiberglass stepladder that was improperly selected, set up, and used. One feasible method to correct the hazard includes, but is not limited to: Follow the manufacturer's instructions for proper selection, set-up, and use of a ladder.
