Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of being struck-by motor vehicles:
On or about August 12, 2009: (a) The employer by not posting advance
warning signs and
and not establishing a transition area containing a merging taper, exposed
employees, who
were performing tree trimming operations in an open lane of traffic on a
multilane roadway,
to the hazards of being struck-by oncoming motorists; and (b) Employees by
not wearing
high-visibility apparel, were exposed to theh hazards of being struck-by a
motor vehicle.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS TO
ABATE THIS HAZARD INCLUDES, BUT IS NOT LIMITED TO: Comply with the
standards contained in the Manual on Uniform Traffic Control Devices
(MUTCD),
Millenium Edition, Part 6, Chapters 6C, 6F, and 6G; and Comply with the
requirements of
the American National Standard for High-Visibility Apparel and Headwear
(ANSI/ISEA 107-
2004).
