Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to the hazard of being struck-by vehicular traffic: On or about October 7, 2009, employees exposed to the hazard of being struck-by vehicular traffic were not provided with and wearing high visibility safety apparel. Abatement Note: One acceptable method of abatement would be to wear high visibility safety apparel meeting the requirements of the American National Standard for High-Visibility Safety Apparel and Headwear (ANSI/ISEA 107-2004).
