Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees
in that
employees were exposed to death or serious injury from being struck-by a
motor vehicle:
On or about December 3, 2009, and times prior thereto, at least one (1)
pedestrian
employee, who routinely crossed SSE Loop 323 (six (6) lane divided
highway) in Tyler, TX,
was exposed to the hazard(s) of being struck-by a motor vehicle.
Among other methods, feasible and acceptable abatement methods to correct
this hazard
include, but are not limited to:
1.Do not permit an employee(s) to cross a public roadway(s) in an area(s)
other than
that designated as a pedestrian crossing(s).
2.Comply with Texas Transportation Code  Title 7. Vehicles and Traffic,
Subtitle C.
