Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about December 14, 2009, at a work site located in the 1000 Block of North Central Expressway in Plano, Texas 75075, at least four (4) employees, who were in the process of closing a lane of traffic, were exposed to the hazard of being struck-by a motor vehicle. Among other methods, one feasible means of abatement includes but is not limited to: a) Complying with the Texas Department of Transportation, Traffic Control Plan for Mobile Operations on Divided Highways, TCP(3-2)-98 which requires a shadow truck equipped with a truck-mounted attenuator to follow 60 to 100 feet behind the work vehicle. b) Following the manufactures warning: Ensure that no one is near, under, or behind the MPS 350 when in operation. Failure to follow this warning could result in serious injury or death to the operator and/or bystanders.
