Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees
in that
employees were exposed to fall and/or struck-by hazards:
On or about February 23, 2010, at a workplace located at 1645 North Town
East Boulevard,
Mesquite, TX, at least one employee, who was performing work while
standing on the tines
of a rough-terrain lift-truck, was exposed to hazards of falling to the
lower level and/or being
struck-by the lift truck.
Among other methods, recognized and feasible means of abatement to correct
these hazards
include, but are not limited to: Comply with both the manufacturer's
operator's manual
(GEHL) and ASME B56.2 1992, Safety Standard for Rough Terrain Forklift
Truck, when
using the lift truck to elevate personnel.
