Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while riding in the bucket of the excavator. a) On or about July 11, 2008, employees were exposed to injury while riding in the bucket of the excavator. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to develop procedures and train operators not to allow any individual on pieces of equipment that is not designed to transport or move individuals. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
