Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards which
were likely to cause death or serious physical harm from injury in that,
employees were exposed
to being asphyxiated from hydrogen sulfide in that, no hydrogen sulfide
evacuation drills had
been performed at this location:
a) On or about August 14, 2008 and at times prior, employees were exposed
to illness in that,
employees were exposed to being asphyxiated from hydrogen sulfide in that
no evacuation
hydrogen sulfide drills had been performed at this location.
Among other methods, one feasible and acceptable method to correct this
hazardous condition
would be to implement and perform an evacuation drill for hydrogen sulfide
which complies
with API RP49-10.7.
