Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing injuries from a suspended shaft-wall enclosure that was constructed/installed in a manner that was not secure or safe: a) On or about August 20, 2008 and at times prior, employees were exposed to crushing injuries from a suspended shaft wall enclosure that was not assembled and installed in a secure or safe manner. The shaft wall enclosure was not assembled and installed in accordance with the manufacturer's (Dietrich Metal Framing) specifications and intended design. The manufacturer's specifications, instructions and intended design do not include suspending shaft walls from a ceiling mounted track without an engineered design. The employer did not employ the services of a licensed engineer to design the system to ensure that the loads imposed by the shaft wall enclosure could be supported by the ceiling mounted track. The framing members were also not installed correctly in that, framing screws were missing where the vertical members meet the ceiling-mounted track in several locations. Among other methods, a feasible and acceptable method to correct this hazard would be to follow the instructions and specifications of the manufacturer for assembly and installation of the shaftwall system. The employer could also employ the services of a licensed engineer in conjunction with adhering to the manufacturer's instructions and specifications to design an appropriate installation. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
