Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards due to improper ladder useage: a) On or about October 24, 2008 and at times prior, Sofa Mart, LLC. did not ensure that employees were protected from fall hazards, in that employees used ladders in a unsafe manner: 1. Employees did not maintain a three point contact with the ladder. 2. Employees did not face the ladder as they made their ascent. 3. Employees carried loads that could cause the employee to lose balance and fall. Among other methods one feasible and acceptable abatement method to correct this hazardous condition would be to develop and implement procedures and training, in accordance with manufacture recommendations (ANSI A14.5-2000), for proper ladder use. Another feasible and acceptable method is to use forklift trucks for lifting heavy, bulky objects. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
