Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to a fall hazards while riding on the tail gate of a pick up truck: a) On or about January 8, 2009 and at times prior, employees were exposed to falls while picking up cones from the tail gate of a pick up truck. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to have employees use a harness and lanyard that is attached to a secured anchor point. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to a struck by hazards while using a pick up truck that had an obstructed Beacon light: a) On or about January 8, 2009 and at times prior, employees were exposed to injury in that, the flashing light on top of the pick up truck was blocked by a sign in the bed of the pick up truck. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to have the sign laid down flat. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
