Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards drop starting chainsaws: a) On or about January 15, 2009 and at times prior, A Family Tree Service, LLC. did not ensure that employees were protected from laceration hazards in that, employees were drop starting a chainsaw. Among others, one feasible and acceptable method of abatement to correct this hazard would be to develop procedures for properly starting a chainsaw that is in accordance with the manufactures recommendations. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
