Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while standing on the mid rail of the basket and exiting the basket of the Wave (work assist vehicle) to load, unload, and retrieve products (boxes): a) On or about January 12, 2009, the employer did not ensure that employees were protected from falls in excess of 12 feet from the floor while loading, unloading, and retrieving products (boxes) from the bays (storage racks) while standing on the midrail of the basket and exiting the basket of the Wave (work assist vehicle). Among other methods, one feasiible and acceptable abatement method to correct these hazards are to ensure that employees do not stand on the midrail of the basket and do not exit the basket once it is elevated. Refer to the Owner's Manual. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
