Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees in
that, employees
were exposed to struck-by hazards (mast) and fall hazards (Geronimo):
a) On or about February 12, 2009, the employer did not ensure that
employees were
protected from struck-by and fall hazards while working with and near #5
rig in the
following:
1) The wire rope clips (clamps) used on the guy lines and Geronimo were not
spaced properly.
2) The wire rope clips (clamps) used on the guy lines and Geronimo were not
the correct size (7/16-5/8 inches) for the size of the wire rope (1/2
inch).
3) The proper number of rope clips (clamps) were not used on the guy lines
and Geronimo.
One feasible and acceptable abatement method among others is to use the
correct size of wire
rope clips for the size of the wire rope according to the manufacturer's
specifications and
according to the American Petroleum Institute Recommended Practices
(API-RP 9B-3.3.8).

were exposed to structural collapse of the rig:
a) On or about February 12, 2009, the employer did not ensure that
employees were
protected from crushing and struck-by hazards while working with and near
#5 rig.
Proper inspections and preventative maintenance were not being performed
on the rig
super-structure. The super-structure had bent and twisted uprights,
struts, beams, and
braces.
One feasible and acceptable abatement method among others is to develop
and implement
procedures for inspections, maintenance, and repair of rig
super-structures that conforms to
the American Petroleum Institute Recommended Practices (API-RP 4G) Third
Edition, April
2004.
