Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing injuries: a) On or about March 23, 2009 and times prior, employees were exposed to serious injuries from being crushed by the backhoe bucket. During the operation of the JD 200 CL backhoe, hand signals or other forms of communication were not used for direction of work. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide radios to be used when employees are out of the line of sight of the operator. Abatement Verification: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
