Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, the use of seat belts by employees operating forklifts was not enforced, exposing employees to crushing injuries in the event of a forklift tip-over or other accident: a. On or about August 6, 2009, an employee operating a Hyster powered industrial truck was not wearing a seat belt, exposing them to serious injuries in the event of a tip-over or other accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees are trained regarding the hazards associated with not wearing seat belts and to implement an active and effective enforcement policy. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall hazards: a. On or about August 6, 2009, and at times prior, an employee was exposed to fall hazards from changing a ceiling mounted light bulb while working from a non-load rated raised work platform. The work platform was attached to the forks of a powered industrial truck. Among other methods, one acceptable abatement method to correct this hazard is to follow ANSI/ITSDF B56.1-2005, Safety Standard for Low Lift and High Lift Trucks, Section 7.37.3. The standard states, in part, the work platform shall have the following information prominently indicated on the platform: 1. Maximum load including personnel and equipment. 2. Weight of empty platform. 3. Minimum capacity of truck on which the platform can be used. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
