Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to the hazard of
falling:
On or about 10/07/08, an employee was working from the front of a
Caterpillar 924G front-end-
loader exposing the employee to the hazard of a fall or being crushed.
Among other methods of abatement, one feasible and acceptable method to
correct the hazard
is to prohibit employees from using the front end loader to lift employees
or using the bucket
as a work platform.
