Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.On or about 11/25/2008, at Antillean Marine Shipping, Corp., North Miami River, FL. Employees were exposed to caught and struck by hazards when two empty intermodal containers were hoisted together by a crane, next to each other, with only two hook wires connected to each container. Among the feasible and useful methods to correct the hazard are: 1.Perform hoisting of the two empty intermodal containers by following OSHA acceptable methods for multiple container operations. 2.Perform hoisting of each intermodal container separately by following ILO rules. 3.Prohibit hoisting of intermodal containers by using two corners only. In the alternative: 29 CFR 1917.71(f): Containers were not handled using lifting fittings or other arrangements suitable and intended for the purpose as set forth in section 29 CFR 1917.71(f)(1) - (f)(4): a.On or about 11/25/2008, at Antillean Marine Shipping, Corp., North Miami River, FL. Employees were exposed to caught and struck by hazards when two empty intermodal containers were hoisted together by a crane, next to each other, with only two hook wires connected to each container. Note:Certification and documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c) and (d), respectively.
