Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to a struck-by
hazard:
On or about December 31, 2008 at Orange Grove Camp Key Road, employees
were exposed
to the hazard of being struck-by a goat that was being operated in reverse
in the grove area and
the operator had limited visibility of the crew members.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is:
a) to install a back-up alarm as well as mirrors (side and rear view) to
enhance the operator's
visibility when operating the goat in reverse;
b) to use a ground guide while the loader truck is reversing.
