Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and caught-between hazards: On or about 01/01/2009, at 5890 SW 8th Street, in West Miami, Florida, employees were exposed to the hazard of being caught-between and struck-by a sliding gate. ABATEMENT NOTE: Among other methods, one feasible and useful method to correct the hazard is for employees to enter and exit the establishment through entries designated for pedestrians such as the north glass door. PLEASE NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
