Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) powered industrial truck operators were exposed to the hazards of falling; and b) employees walking/working through the marine terminal areas were exposed to the hazards of being struck, caught between, or caught under powered industrial trucks: On or about 01/20/2009, at 4550 Anglers Avenue, in Fort Lauderdale, FL, a TCM powered industrial truck was missing a seat restraint system. On or about 01/20/2009, at 4550 Anglers Avenue, in Fort Lauderdale, FL, a TCM powered industrial truck had an un-operable back-up alarm system. On or about 01/20/2009, at 4550 Anglers Avenue, in Fort Lauderdale, FL, a Taylor Machine Works powered industrial truck was missing rear view mirrors. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to comply with the manufacturers' recommendations: 1) Restore the TCM powered industrial truck to its original condition, install a seat restraint system, and ensure that the back-up alarm is operational. 2) Restore the Taylor Works powered industrial truck to its original condition and ensure that the back-up alarm is operational. PLEASE NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
