Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 02-02-2009, an employee was working from the front bucket of a Case 580M front end loader exposing the employee to the hazard of a fall or being crushed. Among other methods of abatement, one feasible and acceptable method to correct the hazard is to utilize an aerial lift.l
