Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm including being caught in or crushed by a fork lift or the fork lift load, to employees in that employees were exposed to being caught in or crushed by the fork lift or fork lift load. a)Packaging Building: Fork lift operator was exposed to being thrown from and/or being crushed by the fork lift that he was operating, in that, he was not wearing a seat belt while operating a Daewoo fork lift, model G30E, serial number E-913353, while moving materials. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: 1)Conform to the requirements of the Daewoo model G30E Operators manual section "Meet Your Forklift" that states, "Safety Belts (used whenever you're driving)" 2)Conform to the requirements of ASME/ANSI B56. la-1989 Addenda to ASME B56.1-1993 Safety Standard that requires the use of seat belts and for manufacturers to develop a program to retrofit older models. NO CERTIFICATION REQUIRED.
