General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and/or struck-by hazards: a)jobsite, the employer used the bucket of a Komatsu PC200LC excavator to aid an employee exiting a 12-foot deep excavation. The employee rode in the bucket of the excavator from the top of an 8-foot high manhole box to the surface of the excavation. Among other methods, one feasible and acceptable method to abate this hazard is to ensure that other means of egress are used to allow employees to safely exit the manhole box and excavation.
