SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that operating a Caterpillar excavator, Model 330, without the swing radius barricaded constituted a hazard of employees being struck by the rotating superstructure. A feasible and useful method, among others, to correct this hazard is to install a barricade around swing radius.

SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that employee operating a Caterpillar excavator, Model 330, equipped with a rollover protection system, without wearing the seatbelt was exposed to the hazard of being thrown from the excavator at the future Waffle House job site. A feasible and useful method, among others, to correct this hazard is to insure employees wear the seatbelt when operating the excavator. B. Employer knew or should have known that employee operating an Ingersoll-Rand roller/compactor, Model SD105-DX, equipped with a rollover protection system, without wearing the seatbelt was exposed to the hazard of being thrown from the roller/compactor at the future Waffle House jobsite. A feasible and useful method, among others, to correct this hazard is to ensure employees wear the seatbelt when operating the roller/compactor.
