SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that employee operating a Lull forklift, Model 644TT34, with no seat belt installed constituted a hazard of the employee being thrown from the forklift at the Key West Villas job site. A feasible and useful method, among others, to correct this hazard is to install a seat belt and ensure that operator wears it when operating the forklift.

Employer knew or should have known that employee operating a Lull forklift, Model 644TT34, with the operator's seat not attached to the forklift, constituted a hazard of the employee being thrown from the forklift at the Key West Villas job site. A feasible and useful method, among others, to correct this hazard is to ensure the operator's seat is securely fastened to the forklift per manufacturer's design.

Employer knew or should have known that employee operating a Lull forklift, Model 644TT34, with an inoperable reverse signal alarm constituted a hazard of employees being struck by the forklift when it is moving in reverse. A feasible and useful method, among others, to correct this hazard is to ensure the reverse signal alarm is working properly.
