SCRR 71-112A: Failed to furnish a place of employment which is free of
recognized hazards
which may cause death or serious physical harm to his employees and comply
with this
regulation and other occupational safety and health rules and regulations
promulgated under
Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as
amended, as
follows:
A.  On or about October 19, 2008, employer knew or should have known the
operator
standing on metal grate floor under rotating chance ride inverter portable
Model 414 ride,
Serial Number 414-00899, was exposed to the hazard of being crushed by
rotating
counterweight.  A feasible and useful means of abatement, among others, is
to have
operators not be located in danger area while the ride is in motion.
OR IN THE ALTERNATIVE
SCRR Chapter 71, 1-1910.212(a)(1): Failed to provide one or more methods
of machine
guarding to protect the operator and other employees in the machine area
from hazards such
as those created by point of operation, ingoing nip points, rotating
parts, flying chips and
sparks. Examples of guarding methods are barrier guards, two-hand tripping
devices,
electronic safety devices, etc., as follows:
A.  On or about October 19, 2008, barrier guard not provided around
rotating chance
inverter portable Model 414 ride, Serial Number 414-00899,
