North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling loads: a)establishment- employees operate Tri-Motion air balancers to move machined metal parts. The employer had not developed frequent and periodic inspections, was using damaged wire rope cable on one balancer and was using lifting devices which were not load rated. Among other methods, feasible and acceptable abatement methods to correct this hazard is to: 1-Establish an inspection program for frequent and periodic inspections for the air balancers. 2-Replace damaged wire rope cable with replacement cable available from the manufacturer. 3-Load test and rate the unapproved lifting devices.
