North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina: The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees, in that employees were exposed to, 1) a fall from an elevation
of approximately 20 feet and/or  2)
being struck by or crushed by the "home-made" bucket attachment tied to
the mast with two nylon strips, and/or
3) being struck by or crushed by or the JGL Skytrak forklift outfitted
with the "home-made" bucket attachment
not approved by the manufacturer, effecting the center of gravity of the
forklift.
a)jobsite - 3516 S. Elm - Eugene Street, Greensboro, NC. - a framing
employee was in a "home-made" bucket attachment on a JGL Skytrak
Telehandler (Hertz Rental Equipment number 412-08-5040) raised to a level
which allowed access to a third story window approximately 25 feet
above the ground level. The "home-made" bucket attachment was tied to the
forklift mast with
two makeshift ties and was completely open on the front side. The
"home-made" attachment had
not been approved by the manufacturer of the forklift.
Among other methods, one feasible and acceptable means of abatement is to
use only attachments
approved by the manufacturer for this specific type of forklift and for
the occupation and
transport of personnel.
