of 1970:  The
employer did not furnish employmnent and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
a)facility - being caught between the forklift frame and the ground in the
event the
vehicle was upset or turned over.  The operator was not wearing a seatbelt
while
operating the unmarked Hyster forklift (no visible model or serial number).
Among other methods, one feasible and acceptable abatement method to
correct this
hazard was to install a seatbelt and to require the operator to wear the
seatbelt while
operating the forklift.
